Free Influencer Agreement Template

Every paid collaboration between a brand and a creator should be documented. This free influencer agreement template covers the essentials — deliverables, timeline, payment, usage rights, exclusivity, FTC disclosure and termination — so both sides know what they signed up for.
Use it as a starting point for TikTok, Instagram, YouTube or podcast partnerships. Replace the bracketed fields with your specifics, then have a lawyer review it before signing anything of material value.
INFLUENCER COLLABORATION AGREEMENT
This Influencer Collaboration Agreement ("Agreement") is entered into on [DATE] between:

1. SCOPE OF WORK
The Creator agrees to produce and publish the following content ("Deliverables"):

2. TIMELINE & APPROVAL
- Draft delivery: [DATE], for Brand review
- Revision rounds: up to [NUMBER] rounds of reasonable revisions

- Go-live: on or before [PUBLISH DATE]
3. COMPENSATION

4. USAGE & LICENSING RIGHTS
The Creator grants the Brand a [EXCLUSIVE / NON-EXCLUSIVE], [WORLDWIDE / TERRITORY], [ROYALTY-FREE] license to use the Deliverables for [TERM, e.g. 6 months] on [CHANNELS, e.g. Brand's owned social channels and website]. Paid media use (ads) is [INCLUDED / NOT INCLUDED]. Any use outside this scope requires a separate written agreement.
5. EXCLUSIVITY
For [X] days from publication, the Creator will not publish sponsored content for any direct competitor of the Brand in the category of [CATEGORY]. Non-competing collaborations are unaffected.
6. FTC / DISCLOSURE
The Creator will clearly and conspicuously disclose the paid partnership in each Deliverable in line with applicable law and platform rules (e.g. "#ad", "Paid partnership with [BRAND]"). The Creator confirms that all statements about the Brand are their honest opinion.
7. ORIGINALITY & IP
The Creator warrants that the Deliverables are original, do not infringe any third-party rights, and that all music, footage and images used are properly licensed. The Creator retains ownership of the underlying content, subject to the license in Section 4.
8. CONFIDENTIALITY
Both Parties will keep non-public information shared under this Agreement (including briefs, product roadmaps and fees) confidential and use it only to perform this Agreement.
9. TERMINATION
Either Party may terminate this Agreement for material breach with [X] days' written notice if the breach is not cured. If terminated before publication for reasons not caused by the Creator, the Brand will pay a kill fee of [AMOUNT / % OF FEE].
10. INDEPENDENT CONTRACTOR
The Creator is an independent contractor. Nothing in this Agreement creates an employment, agency or partnership relationship.
11. GOVERNING LAW
This Agreement is governed by the laws of [JURISDICTION]. Disputes will be resolved in the courts of [VENUE].
12. ENTIRE AGREEMENT
This Agreement is the entire understanding between the Parties and supersedes any prior discussions. Amendments must be in writing and signed by both Parties.

What to include in an influencer contract
Deliverables. Spell out every piece of content: platform, format, count, hashtags, links, and the campaign brief. Vague scope is the biggest source of collaboration disputes.
Payment. Fee, currency, schedule and method. A 50 / 50 split (signature / post-publication) is standard for first-time partnerships.
Usage rights. Where can the brand repost the content, for how long, and can they run it as paid ads? Paid media usage usually costs extra — call it out explicitly.
Exclusivity. A short exclusivity window (14–90 days) against direct competitors is fair. Global, category-wide exclusivity is not, unless the fee reflects it.
Disclosure. Under FTC (US), ASA (UK) and equivalent rules elsewhere, sponsored posts must be clearly disclosed. Put the obligation in writing.
Termination & kill fee.What happens if the brand cancels late, or the creator can no longer deliver? A kill fee protects the creator's time; a cure period protects the brand.
